1. Provider and scope
These Terms and Conditions describe the product and the obligations of Michael Quedzuweit, Aurbacherstr. 2, 81541 Munich, Germany, email: info@wp-ai-label.com, as vendor of WP AI Label Pro. Purchases are processed by Freemius, Inc. as authorised reseller and Merchant of Record. The Freemius checkout, EULA and mandatory consumer law also apply to the transaction.
These Terms apply to consumers and business customers. Mandatory consumer rights remain unaffected.
2. Product
WP AI Label Pro is a WordPress plugin for displaying visible labels and additional information relating to selected images. The product features and technical requirements shown on the product page at the time of purchase form part of the agreement.
WP AI Label is a technical tool. It does not provide legal advice or guarantee compliance with labeling, transparency, copyright, privacy, accessibility or other requirements in any country. The website operator remains responsible for determining and meeting the requirements applicable to their website and use case.
3. Free and Pro versions
The Free and Pro features are described on wp-ai-label.com. Pro may include additional profiles, designs, bulk tools and integrations for WordPress images, Elementor and WooCommerce. The plugin is image-only; ordinary video content is not processed.
4. Formation of the contract
The product presentation is not itself a legally binding offer. By completing the Freemius checkout and clicking the clearly labelled order button, the customer submits a binding offer to Freemius as Merchant of Record. Acceptance, payment, invoicing and electronic order confirmation are handled through Freemius. We remain responsible for supplying and supporting WP AI Label Pro as described in the offer.
5. Prices and payment
The total price displayed immediately before the order is submitted applies. Consumer prices include applicable VAT where required. The introductory price may be changed for future purchases without affecting completed purchases.
Unless expressly stated otherwise on the product page, WP AI Label Pro is a one-time purchase and not a subscription. Available payment methods are shown in the Freemius checkout and may include credit or debit card and PayPal. Freemius calculates the final total and applicable taxes before the order is submitted.
6. Digital delivery
WP AI Label Pro is supplied digitally without a physical storage medium. After successful order and payment, the customer receives the download or other electronic delivery method stated during checkout. The customer is responsible for providing a valid email address and maintaining the technical ability to receive and install the product.
7. Technical requirements
Supported WordPress and PHP versions and required integrations are stated on the product page or in the documentation. Compatibility with every future version of WordPress, WooCommerce, Elementor, PHP or other third-party software is not guaranteed beyond mandatory statutory update and conformity obligations.
8. Open-source license and one-website entitlement
Where plugin code is distributed under the GNU General Public License, including GPL-2.0-or-later where applicable, the rights granted by that license remain fully unaffected.
A “1 Website” offer refers to the commercial entitlement supplied with the purchase, such as official activation, updates or support where those services are expressly included in the offer. It does not restrict rights granted under an applicable open-source license. Additional websites require an additional commercial entitlement only for the official services included in the applicable offer.
9. Updates and support
Required security and conformity updates are supplied for the period required by applicable law. Customers should install required updates within a reasonable period after being informed that they are available. Unless expressly promised, a purchase does not create an entitlement to future new features, designs or integrations. Automatic updates, activation services and support are included only when the product page expressly states that they are operational and part of the purchased offer.
10. Statutory rights for digital products
Consumers retain all mandatory rights relating to digital products, including rights concerning supply, functionality, security, conformity, remedies and required updates. Nothing in these Terms excludes or restricts mandatory consumer rights. Information about withdrawal and refunds is provided on our Digital Content, Withdrawal and Refunds page.
11. Liability
We are fully liable for intent, gross negligence and damage resulting from injury to life, body or health. For a slightly negligent breach of a material contractual obligation, liability may be limited to foreseeable damage typical for the contract insofar as legally permitted. Mandatory statutory liability remains unaffected.
12. Privacy
Information about processing personal data is provided in our Privacy Policy.
13. Governing law and final provisions
The laws of the Federal Republic of Germany apply. For consumers, this choice applies only insofar as it does not remove mandatory protection under the law of the country of their habitual residence. If a provision is invalid, the statutory provisions apply in its place and the remaining provisions remain unaffected.
